SUMMARY: This case arose from a homeowner’s insurance claim by the Plaintiffs following a storm which struck their home on June 23, 2018. Plaintiffs alleged that Defendants paid for portions of their claim but should have replaced or repaired the entire roof. Plaintiffs claimed that the roof consisted of original vintage tiles and Defendants severely under-adjusted the claim when the claim should have resulted in their Public Adjuster’s estimate of $185,513.47. (The Court limited the amount of contract damages which could be claimed to this amount.)
Defendant denied that they had paid less than what was owed and denied that they had breached the contract and denied that any of their actions were in bad faith. Defendants claimed that the roof in question was a 100-year-old tile roof in poor condition due to wear and tear and age. Defendants claimed that their estimate was reasonable considering all the factors and evidence presented to them for evaluation. Defendants claimed that they had paid other portions of the claim for damage to the soft metal items (gutters and downspouts).

VERDICT: Jury Trial (Four Days)
(After the Plaintiff rested, the Defendant Demurred as to CSAA Insurance Exchange and Automobile Club of Oklahoma. Plaintiff confessed and the Court Granted the Demurrer as to those two Defendants. The Court also
Granted Defendant’s Demurrer as to the issue of Punitive Damages. The Court denied the Defendant’s Demurrer as to Defendant, CSAA Fire and Casualty Insurance Company, and as well as to the issues of Breach of Contract and Bad Faith.)
The Jury found in Favor of the Plaintiffs and awarded damages Against Defendant, CSAA Fire and Casualty Insurance Company as follows:
• Breach of Contract – $120,000.00
• Bad Faith – $10,000.00
(The Defendant filed an Offer to Confess Judgment in the amount of $75,001.00 on January 18, 2022.)
