General County Information

County Seat: Norman

Opened to settlement in the Land Run of April 22, 1889, Cleveland was one of the seven counties organized as the Oklahoma Territory in 1890. Its first citizens named it for President Grover Cleveland. Osage Indians had fought the Plains Tribes here where settlers built cities and broke the sod for farms. While other cities were battling to become the capital, Norman's mayor skillfully directed a bill through the Territorial Legislature designating Norman as the site for the first institution of higher learning. Although Cleveland County is the eighth smallest Oklahoma county in area, it has the third largest population and two of the state's nine largest cities, Norman and Moore. Farming, oil production and horse breeding are important industries.

Cleveland County is the home of the state's largest comprehensive university, the University of Oklahoma in Norman. Sooner football dominates this county, and the state.

SUMMARY:       Plaintiff alleged that on June 2, 2014, the Defendant collided with her vehicle near 
the intersection of 24th Avenue SW and Main Street in Norman, OK. As a result of the collision, 
Plaintiff claimed medical bills in the amount of
$31,754.19 for treatment of injuries to her back and for which she would need
a future lumbar surgery.

Defendant admitted causing the collision but denied that Plaintiff was injured in the collision. 
Defendant claimed that surgery had been recommended a year prior to the accident for treatment of 
the same symptoms claimed in this case by the Plaintiff.

SUMMARY:       This case arose from two auto accidents involving the Plaintiff and the Defendants. 
On March 8, 2013, at the intersection of 4th Street and Telephone Road in Moore, OK, vehicles 
driven by Plaintiff and Defendant, Bishop, collided. On December 18, 2014, vehicles driven by 
Plaintiff and Defendant, Kimble, collided at the intersection of 19th Street and Eastern Avenue in 
Moore, OK. Plaintiff claimed that she was injured in both accidents. (Plaintiff did not present any 
medical bills.)

Defendant, Bishop, alleged that the impact was not sufficient to have caused any of Plaintiff’s 
injuries. Defendant, Kimble, claimed that his prosthetic leg malfunctioned and he was not able to 
stop before colliding with Plaintiff’s vehicle. He also claimed that Plaintiff had pre-existing 
injuries and denied the nature and extent of Plaintiffs injury claims. (Defendant, Kimble, died 
after the case was filed from causes not related to the accident.)

ISSUES: Professional Negligence (Medical); Wrongful Death

SUMMARY: This case arose from the allegations of the Plaintiffs that their decedent, Walter
Quoetone, sustained injuries and died as the result of negligent treatment by
Defendant in the Emergency Department of Norman Regional Hospital on
August 6, 2012. Plaintiffs claimed that their Decedent was treated and released
from the ER after a diagnosis of a rheumatoid arthritis flare up. Their decedent
was ultimately diagnosed with MRSA 4 days later which was unable to be
controlled and their decedent died 2 ½ months later after becoming blind and
going into a coma.

Defendant agreed that the initial diagnosis was as alleged by the Plaintiffs. But
Defendant spoke with both the decedent’s PCP and his rheumatologist before
the patient was released. The decedent was advised to follow up with his
treating doctors which he did. Those doctors then reassessed and prescribed a
course of treatment after additional diagnoses. Defendant denied that her
treatment of the decedent was negligent in any manner.
